1. Acceptance of Terms

By downloading, installing, or using the BioStat application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and BioStat ("we", "our", or "us"). We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

BioStat is a life expectancy tracking application for Apple Watch and iOS devices that:

• Calculates personalized life expectancy estimates using actuarial models
• Integrates with Apple HealthKit to read health metrics
• Collects lifestyle information through surveys
• Displays countdown timers and statistics on watch complications
• Tracks changes in predicted longevity over time

3. Medical Disclaimer

You expressly understand and agree that:

• Life expectancy predictions are statistical estimates only, based on population data and mathematical models
• No prediction can account for accidents, unforeseen illness, or individual genetic factors
• Predictions are for informational and entertainment purposes only
• You should never use BioStat predictions to make medical, financial, or legal decisions
• Always consult qualified healthcare professionals for health-related concerns
• The App cannot diagnose, treat, cure, or prevent any disease or health condition

We are not responsible for any decisions you make based on the App's predictions or any consequences thereof.

4. Eligibility

To use BioStat, you must:

• Be at least 17 years of age
• Own or have authorized access to an Apple Watch and/or iPhone
• Have an Apple ID and agree to Apple's terms of service
• Have the legal capacity to enter into this agreement

5. User Responsibilities

When using BioStat, you agree to:

• Provide accurate information in surveys (inaccurate data affects prediction quality)
• Use the App only for its intended purpose
• Not attempt to reverse engineer, decompile, or extract source code
• Not use the App in any way that violates applicable laws
• Not share predictions in a way that could mislead others about the nature of the estimates

6. Apple HealthKit Integration

BioStat integrates with Apple HealthKit subject to the following:

• Access to HealthKit data requires your explicit permission
• You may revoke HealthKit access at any time through iOS Settings
• We comply with Apple's HealthKit guidelines and policies
• Health data is processed locally and never transmitted to external servers
• We do not use HealthKit data for advertising or data mining

7. Subscriptions and Payments

7.1 Free Features

The free version of BioStat includes basic life expectancy calculations, limited risk factors, and daily predictions.

7.2 BioStat Pro

BioStat Pro is available as:

• Monthly subscription: Billed monthly, auto-renews until cancelled
• Annual subscription: Billed yearly, auto-renews until cancelled
• Lifetime purchase: One-time payment, permanent access

7.3 Payment Terms

• All purchases are processed through the Apple App Store
• Prices are displayed in your local currency and include applicable taxes
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

7.4 Refunds

All purchases are handled by Apple. Refund requests must be submitted to Apple according to their refund policies. We do not process refunds directly.

8. Intellectual Property

All rights, title, and interest in the App, including but not limited to:

• Software code and algorithms
• User interface design
• Graphics, icons, and visual elements
• The BioStat name and logo
• Documentation and content

are owned by BioStat and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Privacy

Your use of BioStat is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we handle your information.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF PREDICTIONS

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• Predictions will be accurate for any individual
• Defects will be corrected
• The App is free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

12. Indemnification

You agree to indemnify, defend, and hold harmless BioStat and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share through the App

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your license to use the App ends immediately
• You must delete all copies of the App
• Provisions that by their nature should survive termination will survive

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting updated Terms on this page
• Updating the "Last Updated" date
• Providing in-app notification where appropriate

Continued use of the App after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BioStat regarding the use of the App and supersede any prior agreements.
